Question Probation and gun ownership?

Question for the resident legal eagles-

If a person gets put on probation for a misdemeanor 2, and you're not allowed to posses firearms while on probation, what do you do with your guns?

Do they get held in "safekeeping" by the sheriff, like under a PFA or do you have to transfer them to someone else?

Is it possible to request of the court not to be under this requirement?

IIRC, You should be able to have them held by another person who is allowed to possess firearms. The person holding them will have to sign a form stating that they will not allow you access to them. Afterwards, I believe that you get a statement that says that you are now allowed to possess them again.

get them to be held by someone...I didnt have to turn in any paper work...after you are done they just say you can have them again...its pretty painless...it really stinks though if youre a hunter and you cant go out...that killed me

It's possible, but should be established during the pleadings / settlement.

I don't think you can negotiate it after the proceedings. Never hurts to ask.

I know of one case where a lesser charge was pleaded with the stipulation that the defendent could still have / use guns (he was a avid trap shooter).

Ive heard of some cases where people who live off the meat they hunt get to keep their guns...has to do with economic hardship...lots of different things can happen...all depends on the judge...if youre already put on probation then its pretty tough to reverse
