AN ACT

1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for the fee for the
3 sale or transfer of firearms and for the firearms sales
4 surcharge.

5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Sections 6111(b)(3) and 6111.2(a) of Title 18 of
8 the Pennsylvania Consolidated Statutes are amended to read:
9 § 6111. Sale or transfer of firearms.

11 (b) Duty of seller.--No licensed importer, licensed
12 manufacturer or licensed dealer shall sell or deliver any
13 firearm to another person, other than a licensed importer,
14 licensed manufacturer, licensed dealer or licensed collector,
15 until the conditions of subsection (a) have been satisfied and
16 until he has:

18 (3) Requested by means of a telephone call that the
19 Pennsylvania State Police conduct a criminal history,

1 juvenile delinquency history and a mental health record
2 check. The purchaser and the licensed dealer shall provide
3 such information as is necessary to accurately identify the
4 purchaser. The requester shall be charged a fee [equivalent
5 to the cost of providing the service but not to exceed $2] of
6 $10 per buyer or transferee.

8 § 6111.2. Firearm sales surcharge.
9 (a) Surcharge imposed.--There is hereby imposed on each sale
10 of a firearm subject to tax under Article II of the act of March
11 4, 1971 (P.L.6, No.2), known as the Tax Reform Code of 1971, an
12 additional surcharge of [$3] $10. This shall be referred to as
13 the Firearm Sale Surcharge. All moneys received from this
14 surcharge shall be deposited in the Firearm Instant Records
15 Check Fund.

17 Section 2. This act shall take effect October 1, 2007, or
18 immediately, whichever is later.

So it doesn't come as a surprise.

It seems that raising the firearms purchase fees (PICS) appears to have some priority in certain circles can anyone say executive office.

Freedom is not for sale or lease and even the current fees are unacceptable, especially considering the National system will do these checks for free.
