EVANS, BLACKWELL AND PRESTON, JUNE 5, 2007 -------------------------------------------------------------------------------- REFERRED TO COMMITTEE ON JUDICIARY, JUNE 5, 2007 -------------------------------------------------------------------------------- AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for the fee for the 3 sale or transfer of firearms and for the firearms sales 4 surcharge. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Sections 6111(b)(3) and 6111.2(a) of Title 18 of 8 the Pennsylvania Consolidated Statutes are amended to read: 9 § 6111. Sale or transfer of firearms. 10 * * * 11 (b) Duty of seller.--No licensed importer, licensed 12 manufacturer or licensed dealer shall sell or deliver any 13 firearm to another person, other than a licensed importer, 14 licensed manufacturer, licensed dealer or licensed collector, 15 until the conditions of subsection (a) have been satisfied and 16 until he has: 17 * * * 18 (3) Requested by means of a telephone call that the 19 Pennsylvania State Police conduct a criminal history, -------------------------------------------------------------------------------- 1 juvenile delinquency history and a mental health record 2 check. The purchaser and the licensed dealer shall provide 3 such information as is necessary to accurately identify the 4 purchaser. The requester shall be charged a fee [equivalent 5 to the cost of providing the service but not to exceed $2] of 6 $10 per buyer or transferee. 7 * * * 8 § 6111.2. Firearm sales surcharge. 9 (a) Surcharge imposed.--There is hereby imposed on each sale 10 of a firearm subject to tax under Article II of the act of March 11 4, 1971 (P.L.6, No.2), known as the Tax Reform Code of 1971, an 12 additional surcharge of [$3] $10. This shall be referred to as 13 the Firearm Sale Surcharge. All moneys received from this 14 surcharge shall be deposited in the Firearm Instant Records 15 Check Fund. 16 * * * 17 Section 2. This act shall take effect October 1, 2007, or 18 immediately, whichever is later. So it doesn't come as a surprise. |
