Wow is that a good question!............ I really don't know. I would imagine that because constables are in fact independent contractors and answer to no department or higher authority, that they would NOT qualify for class II weapons exemptions.

I sure hope not. With the limited training constables receive ,I shudder to think of them serving warrants SWAT style carrying MP5's.

I can't agree with this statement. IMO, full-auto weapons are no more or less dangerous than any other firearm. JMHO.

It's certainly easier than getting yourself elected Sheriff Title II of GCA 68 appears to say this:

A firearm may be transferred without the payment of the transfer tax imposed by section 5811 to any State, possession of the United States, any political subdivision thereof, or any official police organization of such a government entity engaged in criminal investigations.

That last part might be the killer, as a constables office isn't involved in criminal investigations. But they are considered law enforcement officers per state law. Hard to say, though.

The constable cannot buy the weapon, but the constables organization can. do you think the state of pa is going to buy a mp5 and issue it to just anyone??

Bookmarked it yesterday. Got the heads up from nlcrsn, who posted it there. I'm also aware of threads on ar15.com and mdshooters.com, but have only commented personally here and minimally on oc.org. I just don't have the time to participate in all of these different forums, but appreciate those of you who do visit them sharing the story and contributing to the discussions!
