You might have a point there. I didn't think about the fact that he may be sending it to someone that is not an FFL/SOT. That could indeed cause a problem since the BATFE is so hot to nail people these days.

As far as box #4 on the form goes I did 2 SBRs now and left the box blank on both of them.

being the cheap bastardo that i am, i followed the "inverse" theory.

i did this with an ak so i needed it built so there was a bit more of a process involved....i had the kit directly mailed to builder-he let me know s/n of parts. filled out the form one w s/n etc and sent it off.immediately then ordered the receiver first and had it sent directly to orion (they have an ffl so it was ok) they engraved the required s/n and name/state info (as well as some other markings)and they sent it directly to my builder. as it happened, just a few days after my form 1 was approved all the parts for the build (kit, receiver and some sbr/clone parts) made it all to the builder at the same time. figure i saved about 15 -20 days and $80 or so in shipping coordinating the effort from afar and rolling the dice on the atf approval (thank goodness)

now for an AR its a little easier as you can put it together (the lower that is) and order a complete sbr upper. you just cant mate the 2 together til the paperwork is approved and returned-correct me if im wrong but this is the gameplan when i find an upper im interested in or patiently wait for the fn scar

This is one of those gray areas regarding constructive intent. In other words, if you have the means to build an SBR (even if they aren't together) and it's the only possible configuration you could build with the AR parts you own, it is technically not a great idea to have them in the same house.

I played the safe route and ordered a registered pistol lower while I waited for my F1 to clear but since you are a cheap bastardo - you might not like this idea! . You can then park your short upper on the pistol lower til the cows come home and be good-to-go.

Plus, it'll give you something to do for a future pistol project

Just my advice here. I don't like gray areas or even beige ones.

I agree with stack. I would not be in possession of both a non sbr lower and an upper less than 16" until i had an approved form 1. No sense in getting into a bunch of trouble here.
