Default Arrested for taking a photo of a cop in public?

Yessir, and the charge is "unlawful photography" and "pointing a lazer at an officer"

What will they think of next?

As I understood, if it's in view of the public eye, you can take a picture of it. Am I missing something?

He should sue the deputy, sheriff and the county, I lived in rural TN for 9 years, a county with 9000 people and the sheriff and county courts make up their own law, in TN it is part of the state constution that the lower court called a sessions court are NOT courts of record and no official record of what was said or evidence presented are made, just the disposition. You can bring your own tape recorder if the judge allows.

Also in rural, small counties there is usually 1 TBI agent assigned to the county and he usually was raised in that county and HE investigates complaints aginst local police or sheriff who he has known since childhood, you ahave a hard roe to hoe if you buck them unless you can get the feds involved and even they don't want to get involved if they can duck it.

That is correct according to the The Photographer’s Right: Your Rights and Remedies When Stopped or Confronted for Photography flyer I posted about here: http://www.pafoa.org/forum/general-2...-officers.html (Photography of Law Enforcement Officers).

The way I understand the law is if you are out in public you are fair game to be photographed. They do not need your consent. This better get dropped.

There is no doubt that this arrest was unlawful, but in rural TN its just tough crap unless there is alot of out of county publicity. The charges will probably be dropped but nothing will happen to the deputy.

There needs to be a lawsuit in Federal Court for a civil rights violation seekng actual and punitive damages.
