Purchasing a Firearm From a Private Citizen

Exactly how does this work? Is there a website that explains what the law requires to make it a legal transition? Looked around this site but didn't see anything that addresses this issue (perhaps i just over looked it). Saw a deal here that perks my interest but i really don't want to enter into negotiations with out knowing what the laws in Pa. are! Ex...Background checks ect. Thanx.

Long gun:
Face to face or through the mail is fine. As long as seller does not know buyer is prohibited person. No transfer/FFL needed as long as both parties are PA residents.
Note: As their preference, many sellers will not mail but will FTF. A few will only go through a dealer.

Handgun:
Must go through FFL. Seller can deliver (in person or by shipping through common carrier, or having another FFL ship) to your local FFL where you go and pick up. Fed 4473 and SP-4 forms filled out and background check done. + FFL fees. Exceptions (no transfer needed) are for parent-child, child-parent, grandparent-child, child-grandparent and spouse to spouse.

Ok, that makes sense, other then the no transfer needed part. By 'no transfer needed' does that mean no paperwork at all? Or is there a form that needs filled out?....Thanx!

I sold a 9mm to a guy I work with recently and the process was very easy, we went to a local gun shop he paid the $20.00 transfer fee and I signed one paper as the seller they did a quick phone check on the buyer and he filled out the usual sheets for a handgun purchase and that was it.

we are both PA residents, I have never done a state to state handgun transfer though. I imagine it would not be difficult.

Has anyone did a handgun transfer to WV? for future reference?

Handgun or rifle, for out of state transfer = ship gun to FFL in receiving state.

varies but most are $20.....that's been my experience.

I thought you couldn't ship one unless it's landing at an FFL first?

Neither federal nor Pa. law prohibits shipping a long gun between Pa. residents. There is no law requiring transfer through an FFL for intra-state long gun (title 1 firearms only) and there is no law prohibiting loans of long guns.

So this means that Pa. residents can ship long guns between themselves for either loan or transfer .

Important note: To transfer or loan a long gun via shipping the same requirements exist as FTF. Namely that you have no knowledge that the person is prohibited. That's it.
